Notice of claimed infringement

If you believe material available through the website infringes a copyright you own or are authorized to enforce, send a written notice containing:

  1. Your physical or electronic signature.
  2. Identification of the copyrighted work claimed to have been infringed or, if one notice covers multiple works on the website, a representative list.
  3. Identification of the material claimed to be infringing, with enough information for GPS to locate it, preferably the exact URL.
  4. Your name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that use of the material in the complained-of manner is not authorized by the copyright owner, its agent, or the law.
  6. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act for the owner.

GPS response

After receiving a valid notice, GPS may remove or disable access to the material, notify the person who supplied it, request additional information, or take another appropriate action. Removal does not constitute an admission of infringement.

GPS may terminate accounts of users who repeatedly infringe copyrights when appropriate. We may document notices, counter-notices, and related communications and disclose them when necessary to administer the process or comply with law.

Counter-notice

If material you supplied was removed or disabled because of a copyright notice and you believe the removal resulted from mistake or misidentification, you may send a written counter-notice containing:

  1. Your physical or electronic signature.
  2. Identification of the material removed or disabled and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled because of mistake or misidentification.
  4. Your name, address, and telephone number.
  5. A statement that you consent to the jurisdiction of the appropriate United States Federal District Court for your address, or, if your address is outside the United States, the federal judicial district in which GPS may be found, and that you will accept service of process from the person who submitted the original notice or that person’s agent.

Send the counter-notice to the Copyright Agent. GPS may restore the material as permitted by law unless the original claimant timely notifies GPS that a court action has been filed seeking to restrain the alleged infringement.

Misrepresentations

Knowingly making a material misrepresentation in an infringement notice or counter-notice may create liability. Consider whether fair use, license, public-domain status, or another legal limitation applies before submitting a notice. GPS may seek advice from counsel and may reject or take no action on notices that do not satisfy applicable requirements.
